CANADA LABOUR CODE PART II MANDATES WORKPLACE HEALTH & SAFETY

The Canada Labour Code, Part II (also know as The Code) is the federal legislation that mandates the health and safety of workers across a broad swath of inter-provincial and international industries throughout Canada, from the public sector and Crown corporations to categories such as transportation, trucking, railways, infrastructure and many more. Being familiar and in compliance with The Code is of the highest importance for management. It is your responsibility as a manager or supervisor to know whether the Canada Labour Code Part II applies to your organization, and if so, to ensure that all aspects of the Code are followed and that your organization stays in compliance across all departments, locations, facilities and work sites.

Part II of the Canada Labour Code is the specific section that deals with occupational health & safety. Its aim is to reduce the number and severity of workplace injuries in Canada. Failure to comply with any aspect of Part II of the Code can result in fines and/or jail time. It can also lead to negative PR which would damage your company’s reputation. That’s why it’s vital that you are aware of the Canada Labour Code and your legal responsibilities to workplace health & safety. Preparedness and prevention are major components of meeting these duties, and proper training and planning are crucial steps towards preventing health & safety issues as well as towards being prepared for any incidents or emergencies that could arise.

YOUR RIGHTS & RESPONSIBILITIES UNDER THE CODE

Employees of any organization governed by the Canada Labour Code Part II are given three essential rights:

  • The right to know
  • The right to participate
  • The right to refuse dangerous work

In addition, most workplaces (those with 20+ employees) are required to have a health & safety committee (those with 19 or fewer employees need to have a health & safety rep), with at least half the committee consisting of non-managerial staff. Companies are also subject to visits from and inspections/investigations performed by health & safety officers. This means that, in order to maintain good standing as safe and sound operation, your organization must be proactive in taking measures to ensure compliance with the Canada Labour Code Part II.
